These Terms and Conditions of Use (the “Terms”) govern the access, browsing, registration, and use of the website, digital platform, online store, forms, reservations, community areas, content, features, products, and services marketed, managed, or made available by Escape World Pandora (hereinafter, “Escape World Pandora,” the “Operator,” “we,” “us,” or “our”).
By accessing or using the Services, the user represents that they have read, understood, and agreed to be legally bound by these Terms and by the Privacy Policy. If the user does not agree with them, they must refrain from accessing or using the Services.
1. Identification of the Operator
The Services are provided by Escape World Pandora, with legal domicile in Heredia, Costa Rica, Republic of Costa Rica, general email address soporte@escapeworldpandora.com, and legal / privacy contact channel contacto@escapeworldpandora.com.
Where a product, experience, feature, or integration is offered, in whole or in part, by third parties, this shall be indicated in the applicable interface, during the purchase process, in supplementary documentation, or in the corresponding specific terms.
2. Definitions
For purposes of these Terms:
“Account” means the profile or registration enabled for a user to access certain features.
“User Content” means any data, text, image, audio, video, comment, post, file, design, message, review, project, or other material that the user uploads, publishes, transmits, or shares through the Services.
“Services” means, jointly or separately, the website, store, forms, reservations, memberships, community spaces, content, tools, support, and any other products or services offered under the Escape World Pandora brand.
“User” means any natural or legal person who visits, browses, accesses, registers, purchases, reserves, or uses the Services.
3. Scope of the Services
Escape World Pandora may offer, subject to availability and business development:

an informational and corporate website;

a store for physical, digital, or hybrid goods;

contracting and reservation of professional, creative, technical, or strategic services;

membership, loyalty, benefit, or preferred-access programs;
-
groups, community, posts, comments, editorial content, or collaborative spaces;

content related to creative projects, entertainment, design, video games, artists, brands, developers, entrepreneurs, partners, or proprietary or third-party initiatives;
-
integrations with payment, authentication, logistics, analytics, automation, messaging, hosting, and other technology solution providers.
Escape World Pandora may modify, expand, restrict, or discontinue any of the Services at any time, temporarily or permanently, for technical, operational, commercial, strategic, regulatory, or security reasons.
4. Eligibility and Capacity
The User represents and warrants that they have sufficient legal capacity to accept these Terms and use the Services.
If the User acts on behalf of a legal entity, organization, or third party, they represent and warrant that they have sufficient authority to bind such entity.
Minors may use the Services only to the extent permitted by applicable law and, where applicable, with the authorization and supervision of their parent, guardian, or legal representative.
5. Registration, Account, and Security
Certain features may require the creation of an Account or the use of proprietary or third-party authentication systems.
The User undertakes to:

provide accurate, current, complete, and verifiable information;

keep their registration details up to date;
-
diligently safeguard their access credentials;
-
immediately notify any unauthorized use, suspected compromise, improper access, or security incident related to their Account;

not share, sell, assign, transfer, lease, or make their Account available to third parties, except with the Operator’s express written authorization.
The User shall be responsible for all activity carried out from their Account, unless they can reasonably demonstrate that unauthorized access occurred and was not attributable to their conduct, negligence, or breach.
6. Acceptable Use Rules
The User agrees to use the Services in a lawful, ethical, diligent manner compatible with their intended purpose.
The following are strictly prohibited:

violating laws, regulations, administrative resolutions, or third-party rights;

impersonating identities or misrepresenting connections, affiliations, authorizations, or the origin of content;
-
using the Services for fraud, scams, phishing, manipulation, deception, or abusive practices;
-
publishing, transmitting, or storing defamatory, slanderous, discriminatory, threatening, obscene, unlawful, violent, or hate-inciting content;
-
uploading malware, viruses, malicious code, abusive bots, unauthorized scrapers, automated scripts, or mechanisms that impair the stability, performance, or security of the Services;
-
attempting to gain unauthorized access to networks, systems, restricted areas, accounts, databases, or third-party environments;
-
circumventing technical protection measures, access controls, usage limitations, or security protocols;
-
copying, reproducing, distributing, modifying, reselling, sublicensing, reverse engineering, or commercially exploiting the Services without the Operator’s written authorization;
-
publishing content that infringes copyright, trademarks, trade secrets, image rights, privacy rights, or other third-party rights;
-
interfering with the legitimate use of the Services by other users;
-
using the Services to collect personal data from third parties without a sufficient legal basis or authorization;
-
evading suspensions, restrictions, or blocks previously imposed by the Operator.
Escape World Pandora may, at its reasonable and good-faith sole discretion, monitor, moderate, restrict, suspend, remove, or delete content, access, features, or Accounts whenever it considers that there is a risk of breach, harm to third parties, infringement of rights, legal, technical, or reputational risk, or whenever necessary to preserve the integrity of the platform.
7. User Content
The User retains ownership of any rights lawfully held in their User Content.
However, by uploading, publishing, transmitting, or sharing User Content within the Services, the User grants Escape World Pandora a non-exclusive, worldwide, revocable to the extent legally possible, royalty-free license, sublicensable only to technology and operational providers connected with the provision of the Services, to host, store, reproduce, technically convert, index, communicate, display, and distribute such content solely for the purpose of:

operating, administering, maintaining, and improving the Services;
-
making the content visible within the platform or within the service channels in which the User has chosen to participate;
-
performing backups, audits, security, moderation, business continuity, and technical support;
-
reasonably promoting the platform or the User’s own activity, provided that such use is consistent with the purpose of the service and does not contradict a valid restriction established by the User or by law.
The User represents and warrants that:

they own the User Content or have all licenses, assignments, consents, and authorizations necessary to publish and license it in accordance with these Terms;
-
their User Content does not violate third-party rights or infringe the law;
-
they shall be liable for any claim arising from content attributable to them.
Escape World Pandora assumes no obligation to review all User Content in advance. Notwithstanding the foregoing, it reserves the right to remove, block, de-index, or moderate any content at any time.
8. Intellectual and Industrial Property
Unless expressly stated otherwise, all intellectual and industrial property rights relating to the Services, including software, code, architecture, design, look and feel, interfaces, structure, databases, texts, photographs, illustrations, videos, audiovisual elements, documentation, logos, trademarks, trade names, distinctive signs, and all other materials associated with Escape World Pandora, are the exclusive property of the Operator or its licensors and are protected by applicable national and international laws.
Nothing in these Terms grants the User any right, license, or authorization, whether express or implied, over such assets, except for the limited, revocable, non-exclusive, and non-transferable right to access and use the Services in accordance with these Terms.
9. Intellectual Property Claims
If a person believes, in good faith, that content available through the Services infringes their copyright, trademark, or other intellectual property rights, they may send a notice to soporte@escapeworldpandora.com with sufficient information to identify the claimed content, the allegedly infringed right, the asserted ownership, and the claimant’s contact details.
Escape World Pandora may request additional information, provisionally remove the content, request clarifications from the involved User, or take any reasonable measure while evaluating the claim.
10. Products, Services, Prices, and Availability
Products, services, plans, memberships, prices, promotions, benefits, delivery times, technical conditions, quotas, availability, and features displayed on the platform may vary without prior notice, except where the law requires an offer to be maintained for a specified period or acquired rights to be respected.
Escape World Pandora will make commercially reasonable efforts to ensure that published information is accurate and up to date. However, typographical, visual, descriptive, integration, inventory, or configuration errors may occur. In the event of a manifest error, the Operator may correct the information and, if necessary, cancel the affected transaction, refunding any amount actually charged.
11. Purchases and Payment Processing
When the User makes a purchase, contracts a service, makes a reservation, or submits a payment through the Services, they agree to provide truthful, sufficient, and updated information to process the transaction.
Payments may be processed by external payment gateways or specialized providers. Escape World Pandora shall not store complete card details or other payment instrument data when processing is carried out directly by such third parties, unless strictly necessary and permitted by law.
The User authorizes the charge of the applicable amounts, including price, taxes, logistics costs, fees, or additional charges duly disclosed before confirmation of the transaction.
12. Shipping, Delivery, and Risk
In the case of physical products, preparation, shipping, and delivery times are estimates and may be affected by inventory, carriers, customs, force majeure events, incomplete addresses, geographic restrictions, or incidents outside the Operator’s control.
The User is responsible for carefully reviewing delivery details before completing their purchase. Escape World Pandora shall not be liable for delays, additional costs, or failures arising from incorrect or incomplete information provided by the User.
13. Reservations and Professional Services
Where the Services include advisory services, consulting, design, development, technical support, creative execution, specialized support, or other professional services:
-
the scope of the service shall be the one expressly indicated in the offer, proposal, confirmation, or corresponding listing;
-
timeframes, deliverables, revisions, dependencies, and execution conditions may be subject to additional specific terms;
-
the client must cooperate in a timely manner by providing information, materials, approvals, access, and feedback within a reasonable time;
-
delays caused by the client’s omissions or delays may result in rescheduling, suspension, or adjustment of the timeline without liability for the Operator.
14. Memberships, Benefit Programs, and Promotions
Escape World Pandora may offer memberships, loyalty programs, rewards, discounts, points, early access, or promotional benefits.
Unless expressly stated otherwise:
-
they do not constitute electronic money, financial assets, or a cash-redeemable credit right;
-
they are not transferable or redeemable for money;
-
they may be subject to validity periods, eligibility conditions, caps, exclusions, quotas, availability, or usage rules;
-
they may be modified, suspended, or terminated for commercial, operational, strategic, legal, or technical reasons, without prejudice to respecting acquired rights where legally applicable.
15. Refunds, Returns, Cancellations, and Withdrawal
Escape World Pandora shall apply a reasonable and transparent commercial policy compatible with mandatory consumer protection legislation.
15.1 General Rule
Requests for refunds, exchanges, returns, cancellations, or rescheduling will be evaluated according to:
-
the nature of the product or service purchased;
-
the status of execution or delivery;
-
the existence of customization, quota reservation, download, access, or consumption of content;
-
the cause of the request;
-
applicable law.
Nothing in this policy limits non-waivable consumer rights recognized under Costa Rican regulations or any applicable mandatory rules.
15.2 Physical Products
Unless expressly stated otherwise in the product listing, Escape World Pandora will accept return requests for physical products within fourteen (14) calendar days following delivery, provided that:
-
the product has not been used;
-
it remains in its original condition, with accessories, labels, manuals, and packaging reasonably intact;
-
it is not custom-made, personalized, perishable, intimate, sanitary, or expressly excluded for objective reasons of hygiene, safety, or the nature of the good.
If the product has a manufacturing damage, material defect, substantial dispatch error, or does not correspond to what was purchased, the user must notify Escape World Pandora within a reasonable period after receipt, providing sufficient evidence. Once the incident has been verified, Escape World Pandora may, at its reasonable discretion and as applicable:
-
replace the product;
-
repair the product, if feasible;
-
issue credit in favor of the user; or
-
refund the amount actually paid.
Where the return is due to the customer’s convenience and not to breach, defect, or error attributable to Escape World Pandora, the direct return costs may be borne by the user, unless otherwise provided by law or by a more favorable express promotion.
15.3 Digital Products
Unless otherwise provided by law, digital products, downloadable items, access rights, on-demand content, files, licenses, creative materials, or intangible deliverables shall not be refundable once:
-
access has been enabled;
-
the download has been made;
-
digital delivery has been completed;
-
the content has been consumed in whole or in part; or
-
the execution of the digital service has begun.
However, a full or partial refund shall apply where the digital product:
-
cannot be delivered due to a cause attributable to Escape World Pandora;
-
presents a substantial defect that prevents its ordinary use and cannot be corrected within a reasonable time;
-
materially differs from the essential description offered to the user.
15.4 Services, Reservations, and Appointments
For professional, technical, creative, scheduled session, advisory, support, reservation, or appointment services:
-
if Escape World Pandora cancels due to a cause attributable to the platform or an operational impossibility not attributable to the user, the user shall be entitled to rescheduling or a full refund;
-
if the user requests cancellation at least seventy-two (72) hours before the scheduled start of the service, the user may choose rescheduling or a full refund;
-
if cancellation occurs between twenty-four (24) and seventy-two (72) hours before the service, Escape World Pandora may grant a one-time rescheduling or credit in favor of the user and, where applicable, apply a reasonable retention for administrative costs or already committed scheduling costs;
-
if cancellation occurs less than twenty-four (24) hours in advance, or if the user fails to appear, there shall be no obligation to refund, except for justified cause, a more favorable legal provision, or a different commercial decision by the Operator.
If the service has already begun, partial or total refunds shall be subject to the degree of execution, the resources already committed, and the cause of termination.
15.5 Memberships, Subscriptions, and Recurring Benefits
If the platform implements memberships, subscriptions, recurring access, or periodic benefits:
-
the user may cancel future renewal at any time before the next billing cycle;
-
unless otherwise required by law, periods already commenced shall not be subject to prorated refunds once access to the benefits of the corresponding cycle has been enabled;
-
review and potential refund shall apply in cases of duplicate charge, manifest billing error, access not enabled due to a cause attributable to Escape World Pandora, or unauthorized charges duly evidenced.
15.6 Refund Processing
Where a refund is applicable, Escape World Pandora will endeavor to process it through the same payment method originally used, unless technically impossible, restricted by the payment provider, or otherwise agreed with the user.
The actual time for the refund to appear will additionally depend on the payment processor, issuing entity, bank, or financial provider involved.
15.7 Fraud, Abuse, and Chargebacks
Escape World Pandora may reject manifestly abusive, repetitive, or fraudulent requests, as well as suspend accounts or transactions where there are reasonable indications of fraud, abusive chargebacks, unauthorized use, or manipulation of the refund policy.
15.8 Contact for Returns and Refunds
All requests must be sent to contacto@escapeworldpandora.com, indicating the purchaser’s name, order or reference number, date, reason, and relevant evidence.
16. Links, Integrations, and Third-Party Services
The Services may contain links, add-ons, widgets, APIs, tools, engines, gateways, logins, plugins, marketplaces, or resources operated by third parties.
Escape World Pandora does not fully control such resources and therefore is not responsible for their availability, accuracy, legality, security, operation, policies, or content, except to the extent that the law imposes direct liability for integration or intermediation.
Access to and use of third-party tools or services may be subject to the terms and policies of such third parties.
17. Privacy and Personal Data
The processing of personal data by Escape World Pandora is governed by the Privacy Policy, which forms an integral and complementary part of these Terms.
By using the Services, the User acknowledges having read the Privacy Policy and understands that certain data processing activities are necessary for the provision of the Services, the management of purchases and reservations, security, fraud prevention, the handling of requests, and compliance with legal obligations.
18. Electronic Communications
The User accepts that Escape World Pandora may send electronic communications related to their Account, purchases, reservations, support, incidents, security, changes to the Services, and contractual or legal documentation.
Promotional communications shall be sent when there is consent or a sufficient legal basis and always with a reasonable opt-out mechanism, without prejudice to operational, contractual, or legal communications that must continue to be sent.
19. Suspension and Termination
Escape World Pandora may suspend, restrict, or terminate, temporarily or permanently, the User’s access to the Services when, in its reasonable judgment:
-
there is a breach of these Terms;
-
there is risk of fraud, abuse, cyberattack, misappropriation, unlawful use, or harm to third parties;
-
it is necessary to comply with a legal obligation, administrative order, or request from a competent authority;
-
continued access poses a threat to the security, stability, or reputation of the platform.
Suspension or termination shall not extinguish those obligations which, by their nature, must survive, including pending payments, usage restrictions, intellectual property rights, limitations of liability, indemnity obligations, and dispute resolution.
20. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided as is and as available.
Escape World Pandora does not warrant that the Services will be free from errors, interruptions, vulnerabilities, incompatibilities, or delays; nor does it guarantee specific commercial, technical, or strategic results, unless expressly agreed in writing.
Nothing herein shall limit mandatory warranties or non-waivable consumer rights established by law.
21. Limitation of Liability
To the maximum extent permitted by the applicable legal system, Escape World Pandora shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits, loss of opportunity, loss of reputation, loss of information, or business interruption, arising from the use of or inability to use the Services.
Where limitation of liability is legally permissible, the aggregate and total liability of Escape World Pandora to the User, for any cause of action related to the Services, shall not exceed the greater of:
-
the amount actually paid by the User to the Operator during the six (6) months preceding the event giving rise to the claim; or
-
USD 100.
This limitation shall not apply where the law prohibits its exclusion or restriction, nor in cases of willful misconduct, fraud, or infringement of non-waivable rights.
22. Indemnity
The User agrees to defend, indemnify, and hold harmless Escape World Pandora, its affiliates, directors, collaborators, contractors, providers, and licensors from and against claims, damages, losses, liabilities, costs, and reasonable expenses, including legal fees, arising from:

the User’s unlawful or improper use of the Services;
-
breach of these Terms;
-
the User’s User Content;
-
infringement of third-party rights attributable to the User.
23. Force Majeure
Escape World Pandora shall not be liable for breaches, delays, or impossibilities of performance caused by events beyond its reasonable control, including infrastructure failures, internet outages, widespread cyberattacks, acts of authority, labor disputes, pandemics, natural disasters, war, riots, regulatory restrictions, or failures by critical third parties.
24. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Costa Rica, without prejudice to mandatory consumer protection or data protection rules that may apply to the User by operation of law.
Unless otherwise provided by law, any dispute shall be submitted to the competent courts of Costa Rica, with territorial jurisdiction in the Courts of Justice of Heredia.
Before initiating judicial proceedings, the parties shall, in good faith, seek an amicable resolution within a reasonable period, except in cases of urgency, interim measures, or circumstances in which such attempt is not required.
25. Severability
If any provision of these Terms is declared null, invalid, or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
26. Amendments to the Terms
Escape World Pandora may update or amend these Terms to reflect legal, regulatory, technical, operational, commercial, or strategic changes. The version in effect shall indicate the date of its last update.
Where changes are material, reasonable means of communication shall be adopted, such as a prominent notice on the website, notification within the Account, or email, as applicable.
27. Language and Interpretation
If versions are published in more than one language, the Spanish version shall prevail for interpretation purposes, unless otherwise required by mandatory legal provisions.

3.5 Content Provided by the User
Messages, comments, posts, files, images, audios, videos, forms, portfolios, reviews, responses, or any other content that the user uploads, shares, or transmits within the Services.
3.6 Marketing and Preference Data
Communication preferences, subscriptions, campaign responses, interests reasonably inferred from interaction with our content, and opening, reading, or click metrics where such measurements apply.

Wix Analytics for reporting, traffic measurement, site activity, and business performance;

Escape World Pandora does not sell personal data in the traditional sense of indiscriminate commercial transfer. If a parent, guardian, or legal representative believes that a minor has provided us with personal data without valid authorization, they may contact us to request review, deletion, or corrective measures where appropriate.
